CHURCH TAKES OVER
RETAIL LOCATIONS

A downtown retail storefront has
been claimed by a church, adding to
many now taking up prime Palm Drive
retail space. Without a permit, the congregation
constructed a stage, installed
draperies and is holding services.
It’s all in violation of city ordinance
explained Steve Mendoza, Community
Development Director. A church in that
location is not a conforming use.
Mendoza said,” They came in [to the
building department] and asked what
was needed to open up. I told them that
the area is not zoned for a church and
that they needed a CuP in order to operate.”
The church is only a few doors away
from a nearby sports bar. City zoning
ordinances require a bar to be more than
500 feet from a church. It is not clear
if a church can locate within 500 feet
of a bar.

An existing church can object to a
new bar. An existing bar cannot object
to the church. It’s some kind of quirky
bureaucratic loophole that discriminates
against those who elect to drink religiously.
Retail-commercial zoning mandates
Planning Commission oversight allowing
staff and public input to discuss a
change of use from a retail facility.
Retail stores provide sales tax revenue
to the City, a church does not. It’s of
concern for some should the downtown
core become overrun by unregulated
storefront churches.
Church representatives refused repeated
requests for an interview.
Fire and other building safety issues
have been raised. Mendoza said,
“Churches are not exempt and like every
other business a church must follow
the same laws and ordinances.”
